2. THESE TERMS
By using our website (directcutting.com) and placing an order, you agree to be bound by these Terms and Conditions. Please read them carefully before placing your order.
Application:
These terms apply to both business (B2B) and consumer (B2C) customers unless otherwise specified. Where provisions apply only to consumers or only to businesses, this will be clearly stated.
Contract Formation:
These Terms, together with our Privacy Policy, Cookie Policy, Returns Policy, Shipping Policy, and Disclaimer, form the entire agreement between you and us.
3. DEFINITIONS
"Consumer" means an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.
"Business Customer" means a customer purchasing products for business, trade, or professional purposes.
"Custom Products" or "Bespoke Products" means products manufactured to your specific dimensions or requirements, including:
Custom cut-to-order channel lengths
Trapeze brackets (assembled and cut to your specifications)
Any product made to your measurements or specifications
"Standard Stock Products" means products available in our standard catalog without customization.
4. PLACING AN ORDER
Order Process:
When you place an order through our website, you are making an offer to purchase products on these Terms. Your order is an offer that we may accept or decline.
Order Confirmation:
We will send you an order confirmation email acknowledging receipt of your order. This acknowledgment does NOT constitute acceptance of your order.
Order Acceptance:
A contract is formed when we dispatch the goods to you, at which point we accept your offer. We will send you a dispatch notification email when this occurs.
Right to Refuse:
We reserve the right to decline or cancel any order at our discretion, including (but not limited to) cases of:
Pricing errors or technical issues
Stock unavailability
Suspected fraudulent orders
Incomplete or incorrect delivery information
Previous payment issues or account arrears
If we cancel your order after payment, we will provide a full refund within 14 days.
5. PRICES AND PAYMENT
Pricing:
All prices are displayed in British Pounds (GBP) and include VAT at the current rate (20%) where applicable.
Business customers may see prices excluding VAT if logged into a trade account. VAT will be added at checkout and shown on your invoice.
Price Changes:
We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you complete your purchase (click "Place Order").
Pricing Errors:
If we discover a pricing error after you've placed an order, we will:

Give you the option to proceed at the correct price or cancel your order
Provide a full refund if you choose to cancel

7. DELIVERY
Delivery Terms:

Summary:
Standard delivery: 3-5 working days (UK mainland)
Custom cut-to-order items: 5-7 working days (includes production time)
Delivery costs calculated at checkout
Tracking information provided when dispatched
Risk and Title:
Risk passes to you upon delivery (when goods reach your specified address)
Title (ownership) passes to you when we receive full payment and goods are delivered
Failed Delivery:
If delivery fails due to your absence or incorrect address information, you may be charged for re-delivery. Items not collected within 10 working days will be returned and may incur return fees.
8. YOUR RIGHTS TO CANCEL AND RETURNS (CONSUMER CUSTOMERS ONLY)
14-Day Cooling-Off Period:
If you are a consumer buying for personal use, you have the right to cancel your order within 14 days of receiving the goods under the Consumer Contracts Regulations 2013.
IMPORTANT EXCEPTIONS - No Right to Cancel:
The following products are EXCLUDED from the 14-day cooling-off period as they are made to your specifications:
Custom cut-to-order products (any item cut to your specified dimensions)
Trapeze brackets (assembled and cut to your specifications)
Any bespoke or customised orders
Sale/clearance items specifically marked "non-returnable"
These items cannot be returned unless faulty or misdescribed.
How to Cancel (Standard Stock Items):

Return goods unused, in original packaging, within 14 days of notifying us
You are responsible for return postage costs
We will refund you within 14 days of receiving the returned goods
Refund Method:

9. BUSINESS CUSTOMERS
No Cooling-Off Period:
If you are purchasing as a business, the 14-day cooling-off period does not apply.
Returns for Business:
Business customers cannot return products unless:
Goods are faulty or misdescribed
We have agreed to accept the return in writing
Sale/clearance items cannot be returned
Quality Standards:
We will always work with business customers to resolve any issues with faulty or misdescribed products under the Consumer Rights Act 2015 and Sale of Goods Act 1979.
10. PRODUCT QUALITY AND LIABILITY

Be of satisfactory quality
Match their description
Be reasonably fit for their intended purpose
Comply with relevant UK and EU standards (where applicable)
Faulty Goods:
If goods are faulty or not as described, we will repair, replace, or refund as appropriate under the Consumer Rights Act 2015.
Limitation of Liability (Consumer Customers):
Nothing in these terms limits our liability for:
Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Defective products under the Consumer Protection Act 1987
Any other liability that cannot be excluded by UK law
Subject to the above, we are not liable for indirect or consequential losses (e.g., loss of profits, business interruption).
Limitation of Liability (Business Customers):
For business customers, our total liability for:
Breach of contract, negligence, or otherwise arising from the supply of goods is limited to the price paid for the specific goods giving rise to the claim
Indirect, consequential, or special losses (including loss of profits, business interruption, loss of data, wasted time) is excluded entirely
This does not exclude liability for death/personal injury caused by negligence or fraud.
Maximum Liability Period:
Any claims must be brought within 6 years of the issue arising (Limitation Act 1980).
